According to contract, the Company will hand over the mobile phone to Subscriber upon payment of the prepaid amount and first installment.

1. A subscriber is connected to the Promo action based on the results of scoring – verifying of compliance of a subscriber with the set by Operator solvency criteria.

2. Participation in the Promo action is recorded in the agreement with the Subscriber for the term of the Contract period.

3. When connected to the Promo action, the Company will activate the service on the number of Subscriber, which will include the tariff plan “Basic+” and one of the Service Packages.

4. The Service Package includes a certain amount of minutes of voice calls, SMS-messages and the Internet traffic, accrued every 30 calendar days of connection to the Promo action subject to effecting monthly payments under the terms of the Promo action.

5. If a Subscriber refuses the Service, including the tariff plan “Basic+”, cancellation of the Communication Services Agreement and/or Communication Services Public Contract before the expiry of the Contract period, as well as in other cases stipulated by the Agreement, a Subscriber shall pay the residual value of a subscriber terminal according to the conditions of the concluded Agreement.

6. A subscriber may disable the Service, including the tariff plan “Basic+” within the scope of the promotion prior to the expiration of the Contract period only upon the written request of a subscriber, filed with the Kcell Center of the Company.

7. In the event of disabling of a Subscriber from the Service for any reason, the tariff plan “Basic+” on a subscriber number remains in effect until it is changed by a Subscriber.

8. Promo minutes and SMS-messages provided in accordance with the Service are used for making calls and sending messages on the RK territory except for voice calls and sending messages to the 3, 4- and 5-digit short numbers.

9. The promo amount of the Services, including the Additional packages of the mobile Internet at top speed may not be used while roaming.

10. Effective term of the Service Promo Package: During the Reporting period, i.e. thirty (30) calendar days of debiting of the Monthly payment from the Personal account of a Subscriber. The unused during the term amount of the Service Promo Package shall not be carried forward to the next Reporting period. The promo amount of the Service for the relevant Reporting period shall not be provided to a Subscriber, if during this Reporting period the Monthly payment has not been debited in full.

11. Kcell subscribers may use the service promo package at any positive balance, activ – at any balance in the subscriber’s mobile account. Subscribers are responsible to monitor their data usage and allowance renewal.

12. Telecommunications services of the Operator after the use of the Service Promo Package as well as other services not included in the Service Promo Package shall be charged according to the tariff plan “Basic+”, value added services not included in the Tariff plan shall be charged based on the Operator’s tariffs applicable at the time of use of such services.

13. Extra Balance, Mobile Internet Plus, Unlimited Internet, Unlimited Nighttime Internet, Half Year Internet, Quarterly Internet, One Year Internet+,  Internet +, Easy Internet, Bonus Internet, Full Contact, Video Service are not available to Subscribers who use the Service during the Contract period. Activ Subscribers who joined the promo offer before 21.12.2015 will be able to activate the One Year Internet service, in which case data with shorter validity period will take priority (validity period – day on which the last regular data pack provided under the Service expires). When data allowance provided under the Promo offer and One Year Internet service is used up, the speed will get capped to 64 kbps. Service will not be available for activation to Subscribers who joined the promo offer after 21 December 2015

14. The balance of voice minutes and the Internet traffic on the Promo Package shall be checked by dialing the command *123*3*2#OK and/or *111*3#OK.

15. Customer is eligible for this promotional offer if he/she has a high enough credit score (according to the results of Operator’s internal credit check). Only one phone can be purchased on contract, the other are available at full price.

16. Important! When less than 4MB of data allowance is left, it will be reserved for the subscriber’s current session and any further sessions will be charged based on the Tariff rates.

Warranty maintenance

The warranty period for a Subscriber terminal is 12 (twelve) calendar months of signing of the Subscriber Terminal Handover Act (the Act). Warranties are available on the web-site of the manufacturer. Should any defects in a Subscriber terminal be found after signing the Act, a Subscriber must apply to the recommended by the Operator Authorized Service Center (addresses of authorized service centers are available on the web-site of the Operator and the warranty card). Should any defects in a Subscriber terminal be found within the period covered by the manufacturer's warranty and constituting less than ninety (90) calendar days, the warranty period is extended to ninety (90) calendar days from the date of replacement or repair of the product. In other cases no warranty period is extended. The term of warranty repair of a Subscriber terminal amounts to up to thirty (30) calendar days. Information about the activation of the mobile device to the web-site of the manufacturer may be incorrect. Calculation of the warranty period starts from the date of signing of the Act.

Terms of additional packages

The validity of Package – 30 days. All unused services under the Package will be annulled at the end of the Package validity.

When the Package is activated, the services under the Package will be used first, and then Internet traffic under the Tariff.

Several packs can be activated at a time, in which case roaming allowance that expires first will be used up first.

* When inclusive allowance is used up, mobile services are billed as per '11' tariff.
